“Never again” still resonates?

Holocaust survivors and their descendants were joined by top elected officials and Jewish community leaders in a series of commemorations marking Yom Hashoah, Holocaust Remembrance Day, across Canada last week.

In Vancouver, community members gathered together at the Jewish Community Centre of Greater Vancouver April 27, while scores more watched remotely as the traditional in-person ceremony returned for the first time since the beginning of the pandemic.

Marcus Brandt, vice-president of the presenting organization, the Vancouver Holocaust Education Centre, welcomed guests and invited Holocaust survivors to light Yahrzeit candles.

“On Yom Hashoah, we join as a community to remember the six million Jews who perished in the Holocaust at the hands of Nazi Germany and its co-conspirators between 1933 and 1945,” he said. “It is also a day to pay tribute to the Jewish resistance that took place during the Holocaust.”

This year marks the 79th anniversary of the Warsaw Ghetto Uprising, which is the most notable of many acts of Jewish resistance to Nazism.

Marsha Lederman, a journalist who is the daughter of two Holocaust survivors, spoke of the importance of telling our stories.

“When I was growing up,” she said, “the Holocaust was everywhere and nowhere. As far back as I can remember, there were hints and references. My parents talked about things happening in camp. What was this camp? I knew it wasn’t like the summer camp that I went to. I knew a lot of their friends were also at these camps, but I didn’t know the details.”

At the age of 5, Marsha met a new friend whose home was filled with laughter and extended family.

“One day, when I came home from a visit at my friend’s house, I asked my mother what was really a simple, innocent question,” said Lederman. “She has grandparents, why don’t I? My poor mother. She was caught off guard and her answer was truly horrifying – at least as I remember it, because I know memory is very faulty. But, as I recall, she said I didn’t have grandparents because the Germans hated Jews and they killed them by making them take gas showers.”

This response raised more questions than answers for the young girl, not least of which was: “What did we do to make the Germans hate us so much and do they still hate us? It was a horrible introduction to the details of the tragedy of my family and it taught me another terrible lesson: be careful about asking questions because the answers could be murder.”

As a result, much of Lederman’s Holocaust education was gained “through osmosis, rather than sitting down and asking questions,” she said.

Her father died when Lederman was a young woman and, in a tragic turn of events, her mother died just as Lederman had bought a ticket to visit her in Florida, armed with a recorder to finally ask the questions she had hesitated to broach in earlier years.

“It’s taken me years to try to figure out what I could have learned in an afternoon at my mother’s kitchen table,” she said. “I have no way of knowing these things because I didn’t ask. We need to ask and we need to tell.”

Lederman explores these questions in a book being released this month, titled Kiss the Red Stairs: The Holocaust, Once Removed.

Amalia Boe-Fishman (née de Leeuw) was the featured survivor speaker at the Vancouver event. Born in the Netherlands, she was less than a year old when the Germans invaded her country. Her grandparents were soon transported to Auschwitz and murdered.

In what is an extremely rare phenomenon, Amalia, her parents and her brother all survived the war years because a Dutch Christian resistance fighter, Jan Spiekhout, and his family hid members of the de Leeuw family in a variety of hiding places over the course of years. Amalia’s mother even gave birth to another child in 1944. (That child, as well as Boe-Fishman’s oldest son, are both named Jan in honour of their rescuer.) Their survival was a statistical miracle. The Netherlands had among the lowest Jewish survival rate of any country during the Holocaust. Of 140,000 Dutch Jews in 1939, only 38,000 were alive in 1945.

Boe-Fishman recalled the day Canadian forces liberated the Netherlands – it was one of the only times in three years that she had set foot outdoors.

“It was strange and frightening outside and close to so many strangers,” she said. “The Canadian soldiers came rolling in on their tanks, handing out chocolates, everyone smiling, dancing, waving Dutch flags. Then I was told I could go home to my real family. But who were these strangers? I did not want to leave the family Spiekhout. They were my family. After all, I had not seen my real family for three years.”

In 1961, she traveled to Israel to meet members of her family who had made aliyah before the war and to reconnect with her Jewish identity. There, on the kibbutz she was staying, she met a Canadian, whom she married and they subsequently moved to Vancouver and had three children.

In 2009, Boe-Fishman and her three sons traveled to The Hague for the investiture of Jan Spiekhout and his late parents, Durk and Froukje Spiekhout, as Righteous Among the Nations by Yad Vashem.

“To be together with my children, my brother, and the grown children of the Spiekhout family, this was such a moving event in our lives,” she said.

As part of the Vancouver ceremony, Councilor Sarah Kirby-Yung read a proclamation from the City of Vancouver. Cantor Yaakov Orzech chanted El Moleh Rachamim. Lorenzo Tesler-Mabe, Mia Givon and Kat Palmer, members of the third generation, as well as Erin Aberle-Palm, sang and read poetry, accompanied by Vancouver Symphony Orchestra violinist Andrew James Brown and pianist Wendy Bross Stuart, who was also music director of the program.

The following day, a hybrid in-person and virtual event was held at the British Columbia legislature, featuring Premier John Horgan.

“On Yom Hashoah, we are challenged to ensure the words ‘never again’ are supported by action,” he said. “Over the past few years, there has been an increase in antisemitism in B.C., and the Jewish community is one of the most frequently targeted groups in police-reported hate crimes. That’s why our government will continue working to address racism and discrimination in all its forms.… Today, as we remember and honour those who were lost and those who survived, we must recommit to building a more just and inclusive province, where everyone is safe and the horrors of the past are never repeated.”

Michael Lee, member of the legislature for Vancouver-Langara, spoke on behalf of the B.C. Liberal caucus.

“Every year, we commemorate this day and remember the heroes and the Righteous Among Nations who stood up to oppose the most vile, hateful oppression,” Lee said. “We recognize the victims and survivors of the Holocaust, we make a solemn promise to never forget and never again allow such horrific actions to take place. This is a responsibility that we all must carry with us not only today but every day. It is a responsibility we must be better at upholding, as soldiers at this very moment commit war crimes once again in Europe. We have not done enough. Right here in Canada, we see another year of record rises in antisemitism. We have to do better.”

Lee called on the province to adopt the International Holocaust Remembrance Alliance Working Definition of Antisemitism.

MLA Adam Olsen represented the Green party.

“While time distances us from the horrific events, the memories and the stories remain steadfast in our mind and are carried and passed from one generation to the next,” said Olsen. “The Holocaust was an ultimate form of evil, persecution, oppression, genocide, complete disregard for human life, pushed to the most appalling degree…. The Holocaust is a stark reminder of the darkness, the wickedness, that can exist among us. However, it is also important to acknowledge that this is a story of strength, resilience and humanity and, to that, I raise my hands to all of the survivors, the Jewish community, that have ensured that the world knows and hears the stories. As difficult as it is to continue sharing them, we cannot stop hearing them or else we will fall victim to thinking that we have passed that now.”

Rabbi Harry Brechner of Congregation Emanu-El lamented the deaths of Holocaust survivors in the current war in Ukraine, “who died when they were cold, again, and hungry, again, and who died in the face of violence.”

“That never should happen and we all know that,” the rabbi said. “I don’t know how to make those big changes. I’m not a world leader. I’m the leader of a small congregation. But I think we are all leaders of our hearts and if each of us can make that difference, it’s got to have a huge ripple effect.”

Holocaust survivor Leo Vogel said that history records the end of the Holocaust in 1945. “But, for the people who lived through it and survived that horrible blight of human history, for them, 1945 is not when the Holocaust ended,” he said. “It continues to this very day to live in memories and nightmares and ongoing health problems.… The fascist attempt to eradicate the Jewish people must never be forgotten. The memory of the tortured and murdered cannot be shoveled underground as the Nazis did with the ashes. As children in the Holocaust, we were the youngest and, now, in our older years, we are at the tail end of those who can still bear witness.”

Vogel spoke of the unfathomable choice his parents made to hand him over, as a child, to a Christian family for hiding.

“Not long after that deeply painful decision to separate me from them, they were deported to Auschwitz and there they were murdered without ever knowing whether their desperate act to allow me to go into hiding saved my life,” he said. “I get cold chills when I think of the intense agony they went through in making their decision. It would have been their hope, I’m sure, that one day we would once again get together. That day never happened. Their pain must have been overwhelming. Many times, I have wondered what they said to each other and to me the night before they gave me away and, countless times, I have asked myself whether I would have had the strength to do an equal act when my children were young.”

In Ottawa, earlier on April 27, Prime Minister Justin Trudeau touted his government’s steps in fighting antisemitism, including the creation of a special envoy on preserving Holocaust remembrance and combating antisemitism, currently held by Irwin Cotler, and proposed legislation to make denying or diminishing the Holocaust a criminal offence.

“Earlier this year, our country and people around the world were shocked and dismayed to see Nazi imagery displayed in our nation’s capital,” the prime minister said, referring to trucker protests in Ottawa. “For the Jewish community, and for all communities, those images were deeply disturbing. Sadly, this wasn’t a standalone instance. Jewish people are encountering threats and violence more and more both online and in person. This troubling resurgence of antisemitism cannot and will not be ignored. The atrocities of the Holocaust cannot be buried in history.… We must make sure that ‘never again’ truly means never again.”

Shimon Koffler Fogel, chief executive officer of the Centre for Israel and Jewish Affairs, picked up on that theme, noting that the term “never again” was “born out of the Jewish experience but was always intended to be universal in its application.”

“How can we witness the atrocities visited on the Rohingya, the Uighurs or the Yazidi and claim the cry of ‘never again’ has meaning?” he asked. “How can we observe the unvarnished aggression against Ukraine and assert we have taken the lessons of the Holocaust to heart?”

He said he derives hope from the fact that Canada seems to have learned the lesson of the MS St. Louis, the ship filled with Jewish refugees that was turned away from Canada and other safe havens in 1939. Now, Canada is a place, he said, “where fleeing Syrian and Iraqi refugees can rebuild their lives, where Afghani women and girls can fulfil their dreams, where displaced, wartorn Ukrainians can find safe harbour.”

“I take great pride that Canada is so committed to Holocaust remembrance and education,” said Michael Levitt, president and chief executive officer of the Friends of the Simon Wiesenthal Centre, “A major reason is because of the survivors who, after suffering unthinkable adversity in Europe, rebuilt their shattered lives here, in our great country. Their strength, resilience and willingness to share their deeply personal and harrowing stories have been a gift and a source of inspiration to all Canadians.”

Dr. Agnes Klein, a Holocaust survivor, spoke of her family’s wartime experiences. Israel’s ambassador to Canada, Ronen Hoffman, commended Canada on adopting the International Holocaust Remembrance Alliance’s Working Definition of Antisemitism.

A day earlier, at another virtual commemoration from the Montreal Holocaust Museum, Holocaust survivor Max Smart told of his family’s harrowing Holocaust experiences.

Paul Hirschson, consul general of Israel in Montreal, compared the loss of Jewish life, with its incalculable loss of talent, in the Holocaust with the explosion of Jewish talent taking place in this century.

“Jewish talent lost was one of history’s greatest tragedies,” said the diplomat. “The talent emerging is perhaps the most exciting story of the 21st century…. Antisemitism is still widespread, also here in Canada. Montreal, where many survivors found a home, is no exception. We will defeat hate every time. Hatred will never again rob the world of Jewish talent.”

Synagogue’s milestone

Montreal’s Congregation Shaar Hashomayim is 176 years old – and it has been in its current building for 100 years now. Among those who have attended the shul over its long history are Rav Abraham Isaac Kook (who was chief rabbi of British Mandate Palestine), former prime minister Pierre Elliott Trudeau and current Prime Minister Justin Trudeau, legendary musician Leonard Cohen and various members of the Bronfman family. Recently, the historic congregation made history, when it hired Rabba Rachel Kohl Finegold, the first Orthodox woman in Canada to become ordained.

“It remains a traditional synagogue that follows traditional Jewish law,” Finegold told the Independent. “Me being the first female member of the clergy may have been significant, but it only did so in complete consistency with halachah (Jewish law).”

Finegold was among the first group of female students to graduate from Yeshivat Maharat, which is located in the Bronx, N.Y., in 2013. She has chosen as her title the term rabba, although female rabbis exist in other streams of Judaism.

“I walk up to the bimah [pulpit] like my male colleagues, but I go back and sit in the female section, because our building is 100 years old and the bimah resides in the central/men’s part of the sanctuary,” she said. “That is just what the architecture allows.”

Shaar Hashomayim split off from Congregation Shearith Israel (also known as the Spanish and Portuguese Synagogue of Montreal) in 1846. Ashkenazi members – English, German and Polish Jews – wanted to practise rituals and observances more akin to what they were familiar with, rather than what was traditional for the Sephardim. In September 1922, Congregation Shaar Hashomayim moved to 450 Kensington Ave. in Westmount, where it resides to this day. After the Second World War, a school was added to accommodate the new families who had joined the congregation. Further expansion happened in 1967.

“This is among the most grand of Montreal’s synagogues. Their choir is simply like no other and the sound permeates the walls throughout during services,” said Lucy Verebes Shapiro, who, while not a member of Shaar Hashomayim, has visited the shul many times. “There is a notion of great importance about all that transpires within,” she said.

The synagogue cemetery also gets visitors, Jewish and non-Jewish, who are attracted by its denizens.

“I’m a Leonard Cohen fan and visit the cemetery every year on the anniversary of his death,” said Marta Etynkowski. “I’ve never met him, but his poetry and music have helped me through many deep, private, emotional moments throughout my life and it’s one of my biggest regrets that I never saw him while alive. It has become a bit of an annual tradition for many of his fans to pay their respects – some people leave mementos, some play his music there, others just have a private moment in front of his grave. It’s quite beautiful.”

Shaar Hashomayim has a long and rich music tradition. The services are centred around a cantor, who is accompanied by an all-male choir, the origin of which dates back to 1887.

Its museum – the Edward Bronfman Museum – holds much Judaica, including a shofar from Yemen and a few books that are centuries old. It features rotating exhibits and is open to the public.

“In the wake of the COVID pandemic, people often ask, are synagogues still relevant? I think that is because there is a misconception that synagogues are just a place of prayer alone,” said Finegold. “However, many synagogues, and ours in particular, offer a connection to community – that’s something people want. After being isolated and at home for so long, to know that there is a place that has so many doorways to access, is something that will keep the relevance and people coming in for years to come.”

Shira Choir focus of lecture

“To repair the often-shattered world, I cannot think of a better way than to give a voice to those less heard,” said Reverend Hazan Daniel Benlolo, leader of the Montreal Shira Choir, a vocal ensemble comprised exclusively of people with physical and intellectual challenges.

Benlolo was speaking at a Feb. 13 lecture co-hosted by Montreal’s Spanish and Portuguese Synagogue and Victoria’s Kolot Mayim Reform Temple during Jewish Disability Awareness and Inclusion Month, or JDAIM.

Born in Morocco, Benlolo settled with his family in Canada in the 1970s and became the cantor of Montreal’s Spanish and Portuguese Synagogue at the age of 17. He is also a rabbi and an artist who, among other things, designs ketubot (Jewish marriage contracts). Despite his many hats, Benlolo’s true passion, as evidenced throughout his talk, is to provide a stage for those who have seldom been listened to, accepted or appreciated in the community.

While working in Ottawa in 2002, he helped lead the Tamir Neshama Choir, which toured throughout Canada, the United States and Israel.

“It really inspired me and opened my eyes to a new life that I never explored before. To be able to spend time with people of special abilities made my life that much better in so many different ways,” Benlolo said of his Ottawa experience, for which he received a Governor General’s Caring Canadian Award in 2013.

The move back to Montreal came a few years ago. There, Benlolo and his wife Muriel Suissa founded the Shira Choir in 2019, with the assistance of Federation CJA and the Jewish Community Foundation of Montreal. The choir, made up of singers from many cultural backgrounds, performs a wide range of music, from liturgical to Broadway and pop.

Not long after the choir’s formation, the pandemic struck in early 2020. Nevertheless, Benlolo has managed to keep the music playing through Zoom rehearsals and socially distanced visits with choir members.

Benlolo stressed that, too often, people with special needs come in and out of our lives, without our taking the time to engage with them. His simple request to the Zoom audience was “to take the time,” as “it could make a world of difference.”

“They teach me more than I could ever teach them,” is the view Benlolo expresses regularly, saying there is no way to place a value on these relationships.

He emphasized the importance of not patronizing anyone in the choir. That is, audiences should give them a standing ovation only because members of the choir deserved one for the quality of their singing, not for the act of performing itself.

“They have hopes and aspirations. Some are going to fulfil them, some are not,” asserted Benlolo.

The future for the choir, he declared, is to continue to spread love, positivity, inclusion and the sense of community, but not tolerance, a word to which he has a particular aversion. “I don’t want to tolerate you, I want to love you. I want to count you in the community as a full member,” he said.

“We want to continue building from here,” he added. “It can only come to fruition if everyone puts in some effort. Just a little bit of an effort, the results will be so satisfactory, both for the individual and the community, [and] we will learn some new things, we will learn a way of life, that for so long has been hidden.”

Benlolo’s talk covered the recently premièred documentary Just As I Am, which can be viewed on CBC Gem (gem.cbc.ca/media/absolutely-canadian/s21e26). The film, a profile of the adults with special needs in the choir, explores the universal language of music and its ability to transform lives.

Benlolo also presented two short videos, both available on YouTube, showing members of the Shira Choir singing Ed Sheeran’s “Perfect” and Leonard Cohen’s “Hallelujah.”

In his concluding remarks, Benlolo urged the audience to not look upon those who are differently abled as “different” in a pejorative sense. “Different is great,” he said. “Different is beautiful. There is so much untapped talent out there that I am always in search of these people who are hidden gems.”

The Spanish and Portuguese Synagogue in Montreal is the oldest in Canada, tracing its history back to 1760, when the first Jewish settlers arrived in Quebec, making it as old as the province itself.

Now in its 14th year, JDAIM is a unified effort among Jewish organizations and communities throughout the world to build awareness and foster inclusion of people with disabilities and those who love them.

Benlolo’s presentation was the fifth in Kolot Mayim’s six-part series on the theme of Building Bridges: Celebrating Diversity in Jewish Life. The final session in the series features Indigenous artist Patricia June Vickers and Rabbi Adam Cutler of Adath Israel Congregation in Toronto, which is co-sponsoring the event. Stunning Concordia apology

In 2002, when the once and future prime minister of Israel, Binyamin Netanyahu, visited Montreal, a violent riot by anti-Zionists erupted at Concordia University. That was a turning point in a now two-decades-long period of anti-Israel and, in some cases, anti-Jewish activism on Canadian campuses.

Universities across Canada would go on to host events such as Israel Apartheid Week and, on multiple campuses, countless peaceful and less peaceful attacks on Israel and its supporters have occurred. As all of this has transpired, Concordia has had the reputation of having probably the most anti-Zionist and antisemitic campus culture in the country. So, many Jews and other observers were stunned when the Concordia Student Union issued an apology to the Jewish community. Released the day before Yom Hashoah, the statement from the CSU began: “Today, we strive to acknowledge our mistakes and begin the process of correcting ourselves.”

The 500-word letter of apology was an unequivocal denunciation of past CSU actions and approaches.

“Overall, our mistakes can be described in one word, indifference,” it reads. “Indifference to one of the world’s oldest forms of discrimination. Indifference to the concerns of our Jewish students. Indifference to the struggles they have faced. While a common topic of our meetings has been how the CSU can tackle other forms of discrimination or support certain minority groups, the Jewish community and antisemitism are seldom brought up.… The CSU has assisted in fostering a campus culture where Jewish students are afraid to openly identify as Jewish…. Our silence on these issues only benefits the oppressors and sets the belief that these acts are somehow justifiable, which encourages the oppressors to continue this behaviour. This behaviour continues well outside the boundaries of our campus and into a society where they may harm many more individuals.”

In addition to the apology for past behaviours, the statement promises concrete action now and in the future. All elected student union officials will receive training on antisemitism every year. Executive members of all Concordia campus clubs will also receive annual training to identify antisemitism and help foster an environment where Jewish students and members of the community can feel safe and fully included. A bystander prevention program is being developed to help students “identify and safely intervene and/or support Jewish students if they witness an act of antisemitism.”

“While we stood idly by in the past while acts of antisemitism occurred, we hope not to repeat those mistakes again and hope the Jewish community will give us another chance to support them in the future,” the apology concludes.

The statement was issued after a process of listening to Jewish students express their fears and experiences with antisemitism at the university. It was drafted by Eduardo Malorni, currently the student life coordinator of the CSU, who will assume the role of general coordinator (the equivalent of union president) in June.

“We got feedback that it was very appreciated,” Malorni told the Independent. “Some people brought up that it was too little, too late, which is a fair criticism for an organization that’s been around as long as us. But our feedback all seems to be positive.”

Two Jewish campus leaders who also spoke with the Independent were emotional.

“I cried the first time I read it,” said Nicole Nashen, an elected CSU councilor and incoming president of Concordia Hillel.

“We cried together,” said Harrison Kirshner, a vice-president of Concordia Hillel, a CSU councilor and incoming executive member.

“As a student, when I first came to Concordia, I knew in my mind what type of institution this is and I knew that I had to hide part of myself in a sense,” said Kirshner. He would think twice, he said, before mentioning celebrating Jewish holidays, for example. Part of the progress that culminated in the apology, he suggested, was students like him opening up and sharing their experiences.

“I realize that conversation and speaking to people about what we face is a much better way than hiding it and not talking about it and not addressing those issues,” he said. “Because, if we don’t address them, nothing is going to change. But, if we do address and we do talk about the experiences that we face, change can stem from that. That’s what we are seeing happening.”

The campus climate is significantly better than he expected when he arrived.

“I noticed that people were receptive to those discussions, people that I thought maybe wouldn’t be receptive to those discussions were receptive to those discussions,” he said. “Part of the reason is because, instead of going in with a fighting attitude, we need to go in with a respectful attitude, a dialogue attitude, an attitude that allows us to open up a conversation with our fellow councilors who I consider to be allies, friends.”

Nashen also acknowledged a feeling in the pit of her stomach when fellow students would raise the topic of ethnicity.

“I didn’t know how I was going to be labeled or what the reaction was going to be or what assumptions are going to be made about me because of the fact that I’m Jewish,” she said. Elected to the CSU recently for the second time, she said she never foresaw being so welcomed.

Both Kirshner and Nashen credit Malorni, who is not Jewish, for encouraging them to share their stories and for making other Jewish students comfortable to come forward and share their experiences. The letter, they said, came from his heart.

“It did come from the heart,” Malorni admitted, “but it only came from the heart because Harrison and Nikki were so open about talking about the issues they faced and also in setting up meetings with other Jewish students who would never have come near the CSU with a 10-foot pole, setting up meetings and saying it’s safe, you can explain it to them, they’re not going to bite your hand off, because students would never have told us 95% of what they told us, unless those meetings were facilitated by both Harrison and Nikki. That’s why I think, in terms of writing the apology, when it came down to it, it became – I wouldn’t say it was easy to write it – but the words were a little easier to come from brain to paper.”

The letter, of course, comes from a new group of CSU leaders, not from the individuals who were involved before and perpetrated some of the extreme activities, such as a Passover Against Apartheid event a few years ago. The current crop of leaders was elected in a campus vote that saw extremely low turnout. However, Malorni noted, student union votes at Concordia and most universities are notoriously and chronically low, so the small number of voters who endorsed the current leaders is commensurate with the number who voted for the earlier, problematic representatives.

“The majority of messages that I’ve received are shock,” Nashen said. “I would have never imagined this could have ever happened at Concordia.… I think a lot of people, especially maybe people who went to Concordia and were involved in Concordia 10 to 20 years ago, but haven’t kept in the loop about CSU affairs, were just utterly shocked, could not believe it. Then, a lot of current students were reaching out to me saying, ‘I just had shivers reading this.’ I can’t believe that our issues are really being taken seriously and that the CSU really cares to help us fight antisemitism.”

She acknowledged that the apology is the beginning of a process, not the end.

“I don’t think this was a fix-all,” she said. “I think this was the first step that the CSU is taking toward telling the Jewish community that they do care about us now and they are ready to start listening to us and taking our issues seriously. What really put the cherry on top was not just words but it came along with actionable steps.”

Malorni said Concordia has had a national reputation as a tough campus for Jewish students, but he is well aware that other campuses have also had their experiences with conflict.

“While we had the worst reputation for it, it’s not something that doesn’t exist at the other universities,” he said. When the apology was posted, he said, commenters from all over North America recounted their own experiences with antisemitism at their universities.

“It’s not a thing limited to Concordia, despite our little extra bad reputation,” he said. “It’s something that seems to have crossed the bounds of our land.”

Exhibit returns virtually

The exhibition Leonard Cohen: A Crack in Everything was the most popular in the history of the Musée d’art contemporain de Montréal (MAC), recording 315,000 visits over its year-long run. The massive multidisciplinary show, produced by MAC, opened in November 2017 on the first anniversary of the Montreal-born singer-songwriter’s death. A scaled-down version then went on an international tour planned through to 2022, first at the Jewish Museum in New York in 2019 and then at Copenhagen’s GL Strand art centre, where it ran until the COVID pandemic hit. Last month, MAC launched a virtual exhibition of the same name that will be up for three years and available free of charge, but within Canada only.

As was the case with the original, visitors can easily spend hours, if not days, trolling through this exhibit, which blends much of its real-world components with hundreds of related images and music, audio and visual extracts, texts and background information. About 50 artworks from MAC’s permanent collection are also imaginatively linked to Cohen’s poetry, songs, interviews and, sometimes, drawings of himself.

For the original show, MAC director John Zeppetelli and guest curator Victor Schiffman commissioned some 40 Canadian and international artists to find inspiration in Cohen’s life and work. Given a free hand, they produced visual and performance art that drew heavily on multimedia, using technology that often allowed the audience to interact. These unconventional tributes drew mixed critical reaction, but an adoring public, still mourning his loss, was just happy to immerse themselves in all things Cohen.

Cohen’s children, Adam and Lorca, cooperated with the MAC project, and the man himself is said to have given his go-ahead for the concept the year before he died.

With the virtual exhibition, visitors control how much they sample, as they meander through the different portals. The site’s main page has an otherworldly feel, as links drift in a black cosmos and (optional) ethereal soundscape. Visitors can explore the four main themes about Cohen: Poetic Thought; Spirituality & Humility; Love; and Loss & Longing. Or. they can head to the Gallery to search by contributing artist; the two other sections are Echo, audio and transcribed impressions offered by visitors to the original exhibition, and Context, a biographical sketch of Cohen.

With respect to navigating the site, if one wants, for example, to delve into the source of the title, which comes from Cohen’s 1992 masterwork “Anthem” (with the lyrics, “There’s a crack in everything / That’s how the light gets in”), a link under Spirituality & Humility leads to the Montreal electronic band Dear Criminals’ interpretation of the song. Related to that recording is a video of Cohen performing the song in London in 2008, a transcript excerpt of a radio interview he gave for Sony Music in 1992, explaining what the lyrics mean, and a video clip of his rendition of it that year on television in France.

The exhibition stresses how influential Judaism was to Cohen, who was born into a prominent Jewish family in 1934. “A strong spiritual presence inhabits much of Leonard Cohen’s work,” reads an entry. “Raised in the ancestral tradition of Judaism, Cohen discovered and developed an interest in poetry as a child while listening to the Hebrew Bible reading cycles and the sung prayers of the Jewish liturgy.”

Although he left Montreal in the 1960s, Cohen maintained a lifelong membership in Congregation Shaar Hashomayim in Westmount, where he grew up. He turned to its cantor, Gideon Zelermyer, and men’s choir for traditional backup to the title cut from his final album, the haunting “You Want it Darker,” released just weeks before his passing. The choir had a small part in the original exhibition, which has been carried over to the virtual. It appears in South African-born Candice Breitz’s panoramic video installation in which 18 elderly men, fans of Cohen but lacking his talent, were recorded covering “I’m Your Man.”

Honouring history amid virus

Collective memory has always played an important role in Jewish life and traditions. For thousands of years, Jews have celebrated holidays, mourned loss and memorialized history together as a people. And, most often, we have done so in person.

We say Kaddish as a community, celebrate a bris among a gathering of peers and family and come together every year to retell over dinner the story of the exodus of the Jewish people from ancient Egypt. The 20th-century philosopher and historian Isaiah Berlin noted, “All Jews who are at all conscious of their identity as Jews are steeped in history.” The late Lord Rabbi Jonathan Sacks expressed it another way: “Memory for Jews is a religious obligation.”

This past year has presented huge challenges for those institutions that strive to educate the public about history in general and, specifically, the Holocaust. During the pandemic, many museums and educational centres have been forced to choose alternative venues to connect with their members and the larger community. On Yom Hashoah and Kristallnacht, organizations across the world turned to recordings and interactive discussions in their effort to remind people that the Shoah’s messages remain relevant, even if their institution’s doors were temporarily closed.

Finding ways to continue that education and connection on a daily basis has required some creative thinking, said Sarah Fogg, who serves as the head of marketing, communications and PR for the Montreal Holocaust Museum. The museum, which was founded by Holocaust survivors, had been planning to launch a special photographic exhibit this year, highlighting the lives and wartime experiences of 30 survivors from the Montreal area.

“[The exhibit] was something that we had dreamt of for a really long time,” said Fogg. The museum had planned to narrate each of the stories visually using a triptych of personal images and the sharing of an artifact that the survivors had preserved: a father’s cap that he was required to wear at Auschwitz, a woman’s prayer book, an irreplaceable but tattered passport to freedom. But how could such stories be presented in the midst of a pandemic?

“The pandemic completely forced us to change, to rethink, to overhaul the plan we had for the exhibit,” said Fogg, who admitted there was a sense of urgency to the exhibit’s launch. Some of the speakers are now in their 90s and have already retired as volunteers. Plus, 2020 marked the 75th anniversary of the liberation of the concentration camps (and the 41st anniversary of the museum’s founding). This year, 2020, was the ideal time to launch the exhibit.

“[The online presentation] is the result of many brainstorming sessions where we discussed … how we could present this exhibit in a way that is different to other portrait exhibits that have happened around the world,” said Fogg. “And so, the ‘triptych’ as we have been calling it, the three photos, was really the result of wanting to showcase more than one portrait of the survivor and really wanting to showcase their uniqueness and their personalities.”

Fogg said it was in the middle of one of the photography sessions that the staff suddenly realized what was needed to translate this photographic essay to an online presentation. It was the survivors’ own accounts of why their personal artifacts held irreplaceable significance. It was also the story of how they had survived and how it had transformed them, once they began their new lives in Canada.

“So often when we talk about the stories of Holocaust survivors, the narrative tends to end when they leave Europe,” Fogg said. “But there is so much more to talk about.” Many of the survivors, who were children or young adults when they arrived in Montreal, went on to raise a family. All became volunteer speakers through the museum and other organizations in order to educate people about the Holocaust. Some became published authors and teachers. All, Fogg said, became inspiring leaders of their community.

“If I had to summarize what the lesson or the inspiration would be for viewers, it’s resilience. I mean, not only are they incredible survivors who escaped the Holocaust, but they come to Canada, they build new lives, they start careers, they make families and they find happiness again. They are this embodiment of resilience.”

Taken on their own, the artifacts tell dozens of unique and often heart-rending stories about the Holocaust. But they are also testimony to the survivors’ remarkable ability to draw meaning, purpose and even beauty from the darkest of memories. Sarah Engelhard’s black-and-white snapshot tells the story of her first Passover in Canada. Ted Bolgar’s touching account gives renewed significance to friendship and the value of a precious tea set. Marguerite Elias Quddus’s last memory of her father, as he was arrested, is embodied in a bitter-sweet tale about his forgotten eyeglasses.

Following the Second World War, Montreal became a second home for thousands of Holocaust survivors, some who saw it as a temporary port of refuge, and many who stayed to make it their home. The museum was opened in 1979 by members of the Association of Survivors of Nazi Oppression as a means to educating the public about the dangers of antisemitism and racism. More than four decades after its founding, the museum’s legacy still continues to be relevant, Fogg said. And, like the testimonies and artifacts that illumine these stories, the message it carries is an intensely human and important one.

“You know, we’re not talking about numbers or figures, we’re talking about Ted, Leslie, Liselotte and Daisy. These are real people that we love and care about and they are real people whose families and lives were torn apart by the Holocaust,” said Fogg. “And so, I think we can make a parallel to situations today, where real people are continuing to be impacted and devastated by genocide.

“I think what’s beautiful about the exhibit and working with survivors is that they are real people. What better way to understand history and especially difficult, complex and painful history than to hear it from such wonderful and caring and generous individuals,” she said. “They are the best educators and we are so lucky to learn from them, and we’re so lucky that they wanted to be a part of this exhibit.”

The museum’s effort to reach virtual audiences during the pandemic does appear to be working. Fogg said that, since its launch in September, the exhibit has not only been seen by viewers around the world, but has won three international awards for its visual presentation and design. The pandemic may have temporarily limited the world’s physical ability to connect, but it hasn’t stopped innovation or the heartfelt effort to care about others.

Montreal Jewish history in brief

The first Jews in the Montreal area were Sephardim serving in a British regiment. One was Aaron Hart, whose son would later be elected to the legislature to represent the Trois-Rivières area.

By the early 19th century, Ashkenazim from Eastern Europe had begun to trickle in and, by the early 20th century, more than 7,000 Jews had made their way to Montreal, most fleeing antisemitism in the Russian Empire and Europe. Many would arrive to find that prejudice and discriminatory policies weren’t exclusive to distant geography. The election of Ezekiel Hart to the legislature would later inspire a resolution to ban Jews from serving in office. It take another 60 years before a law would be enacted that would give Jews in Lower Canada the right to self-representation.

By the 1930s, Montreal’s Jewish population had increased to 60,000, making it the largest Jewish hub in the country. Many worked in the growing garment industry or owned stores and restaurants in the city. A smaller number moved to the country to become farmers and use skills they brought with them from the old country.

Distrust toward Jews and the growing number of Jewish refugees looking desperately for a new home before and after the Holocaust made immigration to Canada virtually impossible in the early 1940s. It took the efforts of organizations like the Canadian Jewish Congress to push for changes to immigration laws and open doors to refugee families. By the early 1950s, another 9,000 Jewish refugees eventually made their way to Montreal’s port. By the 1970s, those numbers had swelled again, reaching close to 120,000.

Today Montreal’s Jewish community is much smaller, for many reasons, including out-migration from the 1970s to 1990s. But the early Jewish pioneers, those who arrived in Montreal in the 18th and 19th centuries, are not only credited with building new businesses and opportunities for a growing city, but for planting the seeds for Canada’s diverse Jewish community.

כיצד תנאים סביבתיים ושינוי אקלים השפיעו על ההתפתחות האנושית המוקדמת, והאם ניתן לרתום הנדסת חלבונים כדי לחסל את נגיף הקורונה? שאלות אלה ועוד רבות אחרות נבדקו לאחרונה על ידי חוקרים וחוקרות מאוניברסיטת טורונטו והאוניברסיטה העברית בירושלים. זאת, כחלק משותפות אסטרטגית חדשה שנועדה לאפשר לחברי סגל וסטודנטים משני המוסדות לשלב מאמצים ומשאבים לצורך ביצוע מחקרים בינלאומיים פורצי דרך וייחודיים בתחומם, ולהגדיל את החשיפה של אותם מחקרים וטכנולוגיות שיפותחו לשווקים חדשים.

פרופ’ אורון שגריר, סגן נשיא לבינלאומיות באוניברסיטה העברית, אמר כי השותפות מאחדת בין שתי האוניברסיטאות המובילות בישראל ובקנדה, וכי הקריאה להצעות מחקר הביאה עד כה למספר פניות מרתקות. בתקופה מאתגרת זו עבור האוניברסיטאות, שותפויות בינלאומיות מעין אלה ומהוות מסגרת חשובה לקידום ותמיכה בפרויקטים מחקריים שונים, הוא הוסיף.

אחד הפרויקטים המשותפים ינוהל על ידי פרופ’ ארי מטמון, מהמכון למדעי כדור הארץ באוניברסיטה העברית ופרופ’ מיכאל חזן מהמחלקה אנתרופולוגיה באוניברסיטת טורונטו. המחקר יתבצע בחלקו בדרום אפריקה במטרה להבין כיצד שינויי אקלים השפיעו על התפתחותם של בני האדם הראשונים במדבר הקלהארי. פרויקט משותף נוסף ינוהל על ידי פרופ’ סאצ’דב סידהו מאוניברסיטת טורונטו ופרופ’ יוליה שיפמן מהמכון למדעי החיים (ע”ש אלכסנדר סילברמן) בפקולטה למדעי החיים באוניברסיטה העברית. השניים יחקרו ביחד כיצד ניתן לרתום את תחום הנדסת החלבונים לפיתוח טיפולים למחלות כולל נגד נגיף הקורונה. בפרוייקט החדש שלהם: השניים יפתחו מערכי חלבונים לכל הגנים הקיימים בנגיף הקורונה. בסופו של דבר הם אמורים לסלול את הדרך לפיתוח טיפולים אפשריים כנגד המגפה הקשה הזאת.

פשעי שינאה בבית כנסת במונטריאול: פורעים השחיתו ספרי תורה

אלמונים גרמו נזק כבד לבית הכנסת קול יהודה השוכן בשכונת קוט סנט לוק שבמונטריאול. הגבאים של בית הכנסת שהיה סגור לאחרונה בגלל מגיפת הקורונה שפגעה קשה במונטריאול, מצאו שספרי וחפצי קודש הושלכו על הריצפה וכתובות נאצה נראו במקום. בין הנזקים שאחראים להם האלמונים ושמוגדרים פשעי שינאה: תשמישי קדושה (כולל תפילין), גווילי ספר תורה וחפצי קודש שונים הושלכו על הריצפה בצורה המבזה את בית הכנסת. זאת ועוד כתובות נאצה אנטישמיות בגנות הקהילה היהודית נראו בכל מקום.

בית הכנסת כאמור סגור בגלל המגיפה ולא נערכו בון תפילות לאחרונה. לכן לא ברור מתי התרחשו פשעי השינאה במקום, שעוררו את כעסם של חברי הקהילה היהודית במונטריאול שסוערים עקב המקרה החמור.

שכונת קוט סנט לוק בפרבריה של מונטריאול נחשבת לאזור בו גרים יהודים מזה שנים רבות. לאחרונה הצטרפה לשכונה קבוצה גדולה של חסידי בעלזא, שאף פתחה במקום בית מדרש ללימוד תורה ותפילה. לקהילת היהודים בשכונת קוט סנט לוק יש מספר רב של מוסדות קהילתיים עמוסים.

A history of Jewish Montreal

Shalom Montreal: Stories and Contributions of the Jewish Community is at Montreal’s McCord Museum, across from McGill University, until Nov. 11.

The exhibition showcases how Montreal’s diverse Jewish communities have participated in the city’s growth and development, including the remarkable Jewish achievements in various sectors, from arts and culture, health and science, legal and community groups, and business and real estate. It does an excellent job telling the story – through videos, photos, audio recordings, as well as numerous visual displays – of how the Jewish community grew and benefited not only Jews but also continues benefiting all Montrealers.

Montreal now boasts a Jewish population of 90,000. Jewish immigrants began settling there as far back as the 18th century. Between 1904 and 1914, Montreal saw the largest wave of Jewish immigration, with many Jews arriving to the city from Eastern Europe fleeing from antisemitism and violent pogroms. Yiddish culture flourished. More Jews settled in Montreal after the First World War, but far fewer due to Canada’s restrictive policy against Jewish immigrants. Then, after the Second World War, and with new policies in place, several thousand Holocaust survivors immigrated to Montreal, making Yiddish the third most commonly spoken language in the city after French and English.

At the same time, Sephardi Jews from Arab-Muslim countries, also fleeing persecution, arrived in Montreal, including some 10,000 Moroccan Jews who spoke French. This helped them find their place in Quebec, as they set up new institutions featuring their own cultural practices, which differed from those of the Ashkenazim, who had dominated for decades.

Jews of Montreal faced antisemitic policies in the predominantly Catholic and Protestant population, which prohibited Jews from attending Catholic schools, placed barriers for Jews in Protestant schools and even saw a Jewish quota placed in various faculties of McGill University between the 1930s and 1950s. Nonetheless, Jewish contributions to the larger community are recognized today for their positive impact on society in general.

These contributions are highlighted in the exhibition. Jewish architects – Max Kalman, Max Wolfe Roth, David Fred Lebensold and Moshe Safdie, among others – and artists became prominent through their design of important city buildings. Jewish philanthropists, such as the Azrielis, Bronfmans, Cummingses, Hornsteins, Pollacks, Segals and Steinbergs, paid for well-known Montreal educational, cultural, medical and other buildings benefiting all Montrealers. Jewish lawyers, such as Alan B. Gold, Anne-France Goldwater and Irwin Cotler, have promoted social equity, evident in many controversial cases. In 1919, the Canadian Jewish Congress was founded in Montreal – in 2009, the Quebec wing branched off as the Quebec Jewish Congress – providing support to human rights groups.

Jewish contributions to healthcare are particularly noteworthy, with research that has gone beyond the confines of Montreal to benefit the international community. Within the city, Jewish doctors, wanting to counter systemic Catholic and Protestant antisemitic policies, established the Jewish General Hospital in the 1930s. Considered one of the great hospitals in Quebec, it had Canada’s first non-discrimination policy, accepting patients and employees from all communities, and it still thrives today.

Montreal’s clothing industry flourished due to the influence of Jewish immigrants. In the 1930s, the industry employed 35% of Montreal Jewish workers, who were known for their garment skills. Later on, clothing companies founded in Montreal by Jewish families include Reitmans, Le Château, Canadelle, Peerless, Aldo, and clothing brands like Joseph Ribkoff and Parachute.

Shalom Montreal is well worth a visit. It uses entertaining and informative multimedia, along with many visual artifacts, to prove there is far more to Jewish Montreal than its legendary bagels and smoked meat.

A law career with many firsts

During his long career in the field of law in Quebec, Morton Minc has made several firsts. His latest – becoming Concordia’s first jurist-in-residence.

Born in Lublin, Poland, Minc came from a very religious, but also academic, family. His father was studying medicine in Paris when the Second World War broke out. The family made their way to Montreal and started over again, with only $17, provided by the Jewish community.

After graduating from Sir George Williams University with an arts degree, Minc went onto law school at the Université de Montréal, where he won several awards. He then joined a large law firm and eventually opened his own practice, specializing in general commercial banking law. He married his wife, Linda, and they had one daughter, Samantha (who is a vascular surgeon in the United States).

“I then was the first Jewish judge in the history of the municipal court of Montreal,” said Minc of his 1993 appointment. “Then, I was nominated as chief justice of the municipal court of Montreal [in 2009], and I was the first Jewish anglophone judge appointed to the municipal court in their history.

“When I became chief judge, I used the court in a different manner,” he said. “One part of the court was streamlining toward social justice programs, social justice courts and problem-solving courts, and the other was traditional justice. The aim of the social justice court is not only to identify an individual’s problem, but also to assist, rehabilitate and help him/her to find his/her way back into society … once they’ve completed the program set by the court successfully, and even decriminalizes their record when possible. In other words, they were charged with a criminal matter or with statutes where they had to pay all these fines … [and] we had made arrangements with an execution department of the city for them to get amnesty.”

Minc was responsible for initiating the program, including working with judges who specialized in mental health.

“We had Crown prosecutors who specialized in the mental health program and a defence lawyer full-time to assist the offender who had the mental health issue when he/she committed a crime,” said Minc. “These people worked not in a combative way, but it’s what we call, ‘participating justice.’”

Most judicial systems are considered adversarial, where the parties are in opposition to one another. But, in these social justice and problem-solving courts, he explained, everyone is working together on the same “side” toward the good of the person on trial.

“I was responsible for establishing the court for the homeless,” said Minc. “We had judges dedicated to the issue of homelessness, so we’d find the person a place to live if s/he had a mental issue, alcohol issue and/or drug issue…. We’d work toward resolving these problems. It wasn’t necessarily a problem of homelessness.

“We dedicated a court only for these social issues, so that they wouldn’t be in the mainstream of the criminal system … so that they would not be embarrassed; the homeless, they wouldn’t feel ill-at-ease. And, the same thing for mental health and domestic violence court…. I can tell you, the success rate was over 85%. It was a win-win situation…. We had a minister of justice coming to our court every year to see what we were doing in our social programs.”

Minc attributed his own compassion for others to his Jewish heritage and its tradition of involvement with and assistance for those who are less fortunate.

When it came time for him to leave his position, Minc – who said he is not a believer in retirement – was asked to meet with Concordia University president Alan Shepard, provost Graham Carr and the dean of the faculty of arts and science, André Roy. The trio invited Minc to join the history department’s Law and Society Program, and he accepted, becoming the first jurist-in-residence.

“My role, or the goal, is to help students, mentor students, on what they could do in the future, about law school…. You don’t have to necessarily become a lawyer, but to get a law degree, or become a lawyer,” said Minc. “There are all kinds of different other institutions you could work at and use your law background for.”

In addition to introducing students to different aspects of law, Minc is helping students find ways to get involved in the legal system, using his vast knowledge and contacts.

“Perhaps Concordia will have its own law faculty one day,” said Minc. “My goal is to stimulate and excite students about the law – and it seems well-received.

“While Concordia doesn’t have a law school,” he added, “it offers students the option to minor in law and society, and to study issues like governance, crime, conflict and social justice from sociological, historical, anthropological and philosophical perspectives.”

Minc’s appointment as jurist-in-residence is for a two-year term and, while he hopes that his successor continues what he is starting, he is focused on doing what he can do now. So far, all of the events he has organized have sold out.

As example of the types of events he has put on, Minc hosted a fireside chat with now-Chief Justice Richard Wagner of the Supreme Court of Canada, on Nov 23. 2017. The talk covered Wagner’s journey to becoming a judge and what it’s really like to be part of the Supreme Court.

On Oct. 19 last year, Minc hosted an event on the legal and psychological implications of the maltreatment of children. A number of distinguished panelists took part, including Judge Patrick Healy (Quebec Court of Appeal) and Judge Martine Nolin (Court of Quebec, Youth Court Division).

Minc also mentored the Concordia Moot Law Society for a legal debate competition against other Canadian universities. He helped student delegates prepare legal arguments and taught them about legal jargon.

בית המשפט לזכויות האדם במחוז קוויבק קבע בפסק דין תקדימי, כי מעצב שיער יהודי ממונטריאול ששמו ריצ’רד זילברג, יכול לעבוד גם בשבתות כבקשתו. בית המשפט אף קבע לזילברג (בן החמישים וארבע) פיצויים בהיקף של 12,500 דולר.

זילברג שימש ספר שכיר במספרה סלון אורזן של איריס גריסי, שאף היא יהודייה, החל מחודש מאוקטובר 2011. זילברג עבד במספרה שישה ימים בשבוע כולל בשבת, שמתברר שהוא היום העמוס ביותר בשבוע.

במהלך חודש יולי 2012 גריסי הורתה לזילברג להפסיק לעבוד בשבתות, במסגרת מדיניות חדשה שלה שלא לאפשר לעובדיה היהודיים לעבוד ביום זה. גריסי אמרה לזילברג שלא לספר ללקוחות מדוע הוא הפסיק לעבוד בשבתות. זילברג חשב אחרת והוא כן סיפר ללקוחות שלו מדוע הוא אינו עובד עוד בשבתות, וזאת בשל היותו יהודי. גריסי שמעה על כך כחודש לאחר מכן מלקוח קבוע שהתלונן בפניה על כך מעצב השיער שלו לא עובד יותר בשבתות. הלקוח אף כעס עליה והתחיל לריב עימה. בשל כך גיריסי פיטרה מייד את זילברג והיא טענה אז כי הוא הפר את הסכם הסודיות שהיה לו עימה.

בצר לו פנה מעצב השיער היהודי תחילה לנציבות לזכויות האדם במונטריאול, שלאחר מכן פנתה בשמו לבית המשפט. זילברג אמר אז: “אני בן לעם היהודי ואני אוהב את האמונה שלי. אבל אני יכול לבחור איך אני רוצה לחיות את חיי”. גיריסי טענה מצידה בתגובה לטענותיו: “אני פשוט אינני יכולה להיות גזענית נגד זילברג כיוון שגם אני יהודייה. הסיבה לפיטורין שלו לא קשורה לטענתו כי אסרתי עליו לעבוד בשבתות, כי זה אינו נכון. אני פיטרתי אותו כי הוא לא היה אחראי והוא אף רב עם עובד אחר, בזמן שהם עבדו ביחד בשבתות. יש לזכור גם אני לפעמים עובדת בשבתות. אני לא מתכוונת לשלם לזילברג פיצויים, כיוון שאני מואשמת במשהו בטעות. אני לא אוותר ואלחם על כך גם בבית המשפט”. על טענותיה של הבוסית שלו לשעבר אמר זילברג בהחלטיות: “אולי איחרתי פעמיים לעבודה במשך עשרה חודשים, אך הרקע לפיטורים שלי ממש לא נעוץ בכך”. כיוון שגיריסי לא נענתה לדרישותיו של זילברג עד חודש אוקטובר 2015, התיק המשפטי הועבר לדיון בפני בית המשפט לזכויות האדם.

שופט בית המשפט, איוון נולן, קיבל את טענותיו של זילברג שבאיסור עליו לעבוד בשבתות גריסי פוגעת בזכויות החופש, המצפון והדת, כמו גם שמירה על כבודו וכן גם על הזיקה לכבד את חייו הפרטיים. מדובר גם על אפלייה על רקע דתי לעומת העובדים האחרים שאינם יהודים. כאמור השופט אף פסק פיצויים למעצב השיער בגובה של 12,500 דולר. חלוקת הפיצויים היא כדלקמן: 6,000 דולר עבור הנזק החומרני, 4,000 דולר עבור נזקים מוסריים ו-2,500 דולר עבור נזקי עונשים שנגרמו לו. יצויין שנציבות זכויות האדם שהגישה את התביעה מטעמו של זילברג, דרשה במקור פיצויים בהיקף של 20 אלף דולר. זילברג היה מאוכזב שסכום התביעה במלואו לא התקבל על ידי בית המשפט. אך מצד שני הוא ציין כי ההמתנה הארוכה בת החמש השנים להחלטתו של בית המשפט הייתה שווה. לדבריו בית המשפט קיבל את טענתו שאין לפגוע במה שהוא מאמין בו. הוא הוסיף: “בפילוסופיה היהודית אין מקום לאפלייה אפילו לעצמנו, אפילו בין יהודי ליהודי”. גריסי לא הגיבה עד כה לפסק הדין נגדה.
